M/s (ATPIL) was awarded these projects in 1999 to develop in self -financing mode. The mode of development was changed to BOOT mode in 2002. Arbitration proceedings was initiated by ATPIL in 2013. The arbitration proceedings was completed on 7.5.2017 and final award of the sole arbitrator was challenged in the Hon’ble Commercial Court, East District. The Hon’ble Commercial Court has set aside the award for compensation but has awarded the specific performance to the company which is challenged in the Hon’ble High Court of Sikkim. The High Court order of 7^th Oct. 2021 has asked the Dept. to deposit the award money with the Court. GoS has filed an appeal in High Court and however the hearing is continuing. Next date is scheduled on 27^th April 2022.
